IHC seeks clear statement from govt about Imran Khan’s possible military trial. The Islamabad High Court (IHC) has sought a clear stand from the government regarding the possible military trial of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.
Justice Mian Gul Hasan Aurangzeb heard the application today filed by former Prime Minister of Pakistan Imran Khan to stop his possible military custody and trial related to the May 9 cases.
Justice Mian Gul Hasan Aurangzeb inquired about the procedure to be given in military custody from the government prosecutor.
In response, the Additional Attorney General on the behalf of Ministry of Defense replied to the court that no such thing has come yet about military detention and trial. “If any request comes, the action will be taken according to the law,” the prosecutor said.
The representative of the Defense Ministry said that I have done more than 50 cases in the Field General Court, on which the court inquired how you take civilians to military courts
In response, the ministry representative said that the military authority informs the concerned magistrate that if a person violates the Army Act, in that case, he will be court-martialled.
Justice Mian Gul Hasan Aurangzeb questioned, how to determine that a person will undergo a military trial. On which the representative of the Ministry of Defense said that Section 2(1)(d) of the Pakistan Army Act states that a civilian can also be tried under the military trial.
During the hearing, the IHC judge said to the Additional Attorney General that the procedure regarding military trial of civilians is that first, the civil court will frame the charge, if the trial court says that the case is to be sent to the military court, then it can be sent by giving a notice to the government.

Later, the court adjourned the hearing of the case till next Tuesday, seeking a clear statement from the government.
