Brave Yasin Malik declines legal representation, vows to argue his own case in NIA’s death penalty plea

NEW DELHI: Yasin Malik, the leader of the Jammu and Kashmir Liberation Front (JKLF), who has been at the forefront of the struggle for Kashmiri self-determination for decades, has chosen to take a bold stand in his legal battle with the National Investigation Agency (NIA).

As per the details, on Friday, Malik informed the Delhi High Court that he will personally argue against the NIA’s appeal seeking the death penalty for him in a terror funding case.

Appearing via video conference from Tihar Jail, Malik made it clear to the Division Bench, comprising Justice Suresh Kumar Kait and Justice Girish Kathpalia, that he intends to defend himself without the assistance of a lawyer or an amicus curiae. This decision underscores Malik’s determination to control his narrative and defend his actions directly, a rare and courageous move in a high-stakes legal battle.

Malik, who was sentenced to life imprisonment by a trial court in May 2022 after pleading guilty, has consistently maintained his commitment to his cause. Despite the life sentence, he did not contest the charges, instead choosing to face the consequences head-on. His decision to represent himself in the NIA’s appeal further highlights his resolve to stand by his principles, even in the face of severe consequences.

During the hearing, Malik requested to appear in person before the court, arguing that he had been physically present during the trial court proceedings. He pointed out that his presence in court had not caused any law-and-order issues, countering the NIA’s concerns about security.

Malik asserted that his right to a fair trial should allow him to be physically present, but the bench advised him to challenge the earlier order denying this in the Supreme Court. Refusing this suggestion, Malik opted to argue his case through video conference, insisting that his request be recorded.

The court has scheduled the next hearing for September 15, 2024, giving Malik time to decide whether he wishes to file a reply or a written statement with supporting case laws and documents.

Malik’s decision to take on the NIA’s plea without legal representation is a testament to his unyielding spirit and commitment to his cause. Despite facing severe health challenges, including cardiac and kidney-related ailments, for which he has sought medical treatment, Malik remains undeterred in his fight.

The trial court’s earlier judgment had noted that Malik’s case did not meet the criteria for the rarest of rare cases, thereby not warranting the death penalty. Malik’s assertion of following Gandhian principles of non-violence was also part of his defense, although it was not accepted by the court.

As the legal proceedings continue, Malik’s brave decision to represent himself highlights his enduring dedication to his cause and his determination to fight until the very end, regardless of the outcome.
